We have for review Beacon Property Management, Inc. v. PNR, Inc., 785 So. 2d 564 (Fla. 4th DCA 2001), which expressly and directly conflicts with the decisions in Delgado v. J.W. Courtesy Pontiac GMC-Truck, 693 So. 2d 602 (Fla. 2d DCA 1997), Suris v. Gilmore Liquidating, Inc., 651 So. 2d 1282 (Fla. 3d DCA 1995), and Rollins, Inc. v. Heller, 454 So. 2d 580 (Fla. 3d DCA 1984). We have jurisdiction. See art. V, § 3(b)(3), Fla. Const. For the reasons stated herein, we quash the district courts decision and remand with instructions to the district court to reconsider the judgment on Petitioners statutory cause of action.
